With reference to NSW Supreme Court Case Reference# B20200811-7186494, Estate of Maria Alvarez

Client: Benjamin Alvarez of 98 Jersey Rd DHARRUK NSW 2770 Australia

The Client, Mr B Alvarez, has recently instructed us on updates to the situation regarding his late mother's Estate, to wit;

He has recently forwarded by sea mail approximately two pounds of his mother's remains (ashes) to the postal address he has on file for the co-beneficiary, Ms T Alvarez. In Spain (Torrecilla de Leal, Madrid), as per her recent request. He has also forwarded by sea mail various letters, photographs, postcards, and the like, appertaining to his late mother's Estate. He estimates this despatch will arrive around late October due to delays in international shipping routes due the Covid-19 pandemic.

He has instructed us to notify recent costs as including: approximately $3400 for the funeral services of the late Maria Alvarez, approximately $110 for legal filing and paperwork. Ongoing costs include (but are not limited to): electricity, council rates and water service for the Estate. 

The client wishes to notify Ms Alvarez of a unique opportunity to achieve a higher than usual sale price for the property at 98 Jersey Rd, Dharruk. Namely, the property next door at 96 Jersey Rd, being an unusually large sized property, is currently for sale by Ray White Real Estate Mt Druitt on behalf of a property developer who wishes to transform the unusually large lot into a subdivision of duplexes, for which, we understand, they already have zoning approval. Mr Alvarez is currently in negotiations with Ray White Real Estate to sell the property at 98 Jersey Rd to the same developer with a view to achieving a higher than usual sale price. Of course, no binding agreement can be entered into at this point until Probate has been legitimized, however Mr Alvarez would like to strongly encourage the co-beneficiary, Ms T Alvarez, to contact Ray White Real Estate Mt Druitt about the matter to inspect its veracity. Finally, with regard to filing the relevant paperwork with the NSW Supreme Court, our client advises as follows:

That he will be filing all relevant paperwork himself, in his own name, as he feels most comfortable proceeding in this manner. That he will not be charging the co-beneficiary Ms T Alvarez any financial imposition for the advisory service our Entity provides him. That we remind Ms T Alvarez that our Entity is retained by Mr B Alvarez at his own personal expense, and not at that of the Estate, to advise him on legal matters and act as an intermediary service with the co-beneficiary Ms Alvarez. Keeping in mind that relations between the two parties have been generally extremely poor most of their lives and they are generally unable to maintain civil and respectful relations between the two in a normal way. On this latter note, Mr Alvarez has advised that he will be happy to receive mail by post from Ms Alvarez for any and all practical purposes, such as legal filing, requests for family heirlooms and the like, at the address at 98 Jersey Rd Dharruk. Providing she refrain from defamatory attacks, rude, insolent, hostile or otherwise malicious representations and insinuations towards Mr Alvarez to the detriment of his well-being and peace of mind. She may at any time seek out her own legal advice as most relevant to her with regard to her relationship with her brother and her acquisition of the family Estate. The client advises he will not be accepting of any encumbrances financial or otherwise for any legal services Ms Alvarez retains with regard to the distribution of the Family Estate and that she would do so at her own personal expense.

To this latter point, the client requests that the co-beneficiary, Ms T Alvarez, complete UCPR Form 125 attached, as a DOC file or PDF file. The co-beneficiary is also advised to download the relevant form herself either from this email or else from the relevant website: https://www.ucprforms.nsw.gov.au  and complete the form herself or else with the help of a qualified legal applicant. Please be advised to register the Filing Details as: Benjamin Alvarez of 98 Jersey Road DHARRUK NSW 2770 and phone number 0420 782 163 and email address benjamin.alvarez81@gmail.com  as the client insists on filing all documents himself. The relevant notary service required can be found at the Australian Diplomatic Mission in Madrid. Please forward a hard copy of the relevant form 125 to Mr Alvarez at 98 Jersey Rd DHARRUK NSW 2770 and also via email to this address and/or Mr Alvarez's gmail address. If intending to apply as a co-administrator of the Estate please stipulate in the relevant area of Form 125 and request legal aid as necessary (from a different Entity).

The only Executor named in the Will, the late Mr Jose Antonio Alvarez, deceased in February 2017, has functionally abrogated in that end.
